Attorney Steven Schwartz is facing a sanction hearing after submitting fake cases in a lawsuit against Avianca Airlines. The cases, which were used as research for a brief, were found to have bogus citations and quotes by Judge Kevin Castel of the Southern District of New York. The source of the fake cases was revealed to be ChatGPT, a generative artificial intelligence.
Schwartz admitted to using ChatGPT for legal research but claimed he was unaware of the possibility that its content could be false. Avianca's lawyers raised doubts about the authenticity of the cases, leading to an investigation. Schwartz is now facing potential sanctions for his actions. In an affidavit, Schwartz expressed regret and promised not to use generative artificial intelligence without verifying its authenticity in the future.
The court ordered Schwartz to show cause for the use of a false and fraudulent notarization. Screenshots of the attorney's conversation with ChatGPT were presented, where the chatbot initially confirmed the fake case's authenticity but later apologized for the confusion and claimed the case did exist. Schwartz's fellow attorney, Peter Loduca, stated that he had no reason to doubt Schwartz's research and had no role in it.
